These terms are an agreement between you and Lee Fencing Academy, doing business as Globus Fencing Academy ("Globus", "the academy", "we", "us"). By creating an account or using the Globus Fencing app or website, you agree to them. If you use Globus for a child, you agree to these terms for yourself and on the child's behalf.
Our Cancellation and Billing Policy, our Billing Terms and our Privacy Policy are part of these terms. If they differ on how lessons are cancelled or billed, the Cancellation and Billing Policy and the Billing Terms apply. The participation forms described in section 5 are separate documents that you sign for each fencer.
2. Accounts
You must be 18 or older to hold a family account.
A fencer aged 13 to 17 may have their own sign-in only after a parent or guardian gives permission through the email we send them. We record who gave permission and when. The parent or guardian remains responsible for that account and can still see and manage the teen's bookings.
Give us accurate information, including each fencer's real date of birth, and keep it up to date.
Keep your password private. You are responsible for what happens in your account.
The academy reviews and approves new accounts. We may decline an account, and we may suspend or close an account that breaks these terms, leaves amounts unpaid, or puts others at risk. We will tell you why.
3. Lessons, classes and bookings
Bookings depend on availability, on each fencer's eligibility (for example their age group) and on the booking rounds the academy sets for each season.
The academy may change a lesson's coach, time or place when it has to, and may cancel lessons because a coach is unavailable, the academy is closed, or for safety. When the academy cancels a lesson, you are not charged for it, or you receive a full credit if you already paid.
Cancellations you make, waiting lists, class withdrawals, camps and payment for lessons follow our Cancellation and Billing Policy. Each booking screen shows the cancellation rule that applies, in one line, before you confirm.
Before you book, enroll or sign up for a camp, you must have agreed to the versions of these terms and of the Cancellation and Billing Policy that are in force.
4. Payment
You agree to pay for the lessons, classes, camps and other services you book, at the prices shown in the app and on your statements, as described in our Billing Terms and our Cancellation and Billing Policy. We accept payment from a bank account or a debit card. We do not accept credit cards or prepaid cards, and we do not charge a fee for paying.
5. Participation forms
Before a fencer's first booking, class or camp, a parent or guardian (for a fencer under 18) or the adult fencer signs two forms in the app:
the Participation Agreement (Acknowledgment of Risk, Rules and Release); and
the Medical Emergency Authorization.
The forms are signed again every 12 months, and whenever we change them. Until the forms in force are signed, new bookings, class places and camp sign-ups for that fencer wait.
The Photo and Video Consent is a separate, optional choice for each fencer. The answer is No unless you change it, and your answer never affects whether the fencer can take part.
6. Taking part safely
Fencing is a physical sport and carries a risk of injury. Everyone taking part must follow the coaches' instructions, the academy's rules and its equipment and safety requirements. You confirm that each person you book for is fit to take part, and you agree to tell the academy about any medical condition that matters for their safety, using the Medical Emergency Authorization. The risks of fencing, and what you agree about them, are set out in the Participation Agreement. These terms do not replace it.
7. Conduct
You agree, and you agree to make sure the fencers you book for agree, not to:
use another person's account or try to see another family's information;
harass, threaten, bully or abuse staff, coaches, fencers or families, in person or online;
behave in a way that puts the safety of others at risk;
interfere with or try to break the app, the website or their security;
use Globus for anything unlawful.
The academy may remove a person from an activity, or suspend or close an account, when it is needed to keep people safe.
8. SafeSport and keeping young fencers safe
The academy follows the U.S. Center for SafeSport's Minor Athlete Abuse Prevention Policies. In practice this means:
staff communications with a fencer under 18 are open and transparent, and a parent or guardian is included;
our coaches and staff do not send private one-on-one messages to minors, including on social media or Band;
one-on-one time between an adult and a minor at the academy is in a place where others can see and hear, or can easily walk in;
coaches and staff who work with minors keep their SafeSport training and background checks current.
The Globus app has no private messaging. If you have a concern about the safety or treatment of any fencer, please tell the academy owner. Anyone can also report a concern directly to the U.S. Center for SafeSport at uscenterforsafesport.org or 833-587-7233. If you suspect a child is being abused or neglected, report it to law enforcement (call 911 in an emergency) or to the Texas Department of Family and Protective Services Abuse Hotline at 1-800-252-5400 or txabusehotline.org.
9. Messages
We send service messages about your account, bookings and payments by in-app notice, push notification and email, and by text message only if you agreed. Academy news and camp emails are optional. You can manage messages as described in our Privacy Policy.
10. The service
We work to keep Globus available and accurate, but it is provided as it is, and we do not promise it will always be available or free of errors. We may change or improve its features.
11. Limits on our liability
To the fullest extent permitted by law, Globus is not liable for indirect, incidental, special or consequential losses, and our total liability for any claim relating to the app, the website or these terms is limited to the amount you paid us in the three months before the claim.
Nothing in these terms limits:
any right you have under the Texas Deceptive Trade Practices Act that cannot be waived;
our liability for gross negligence or wilful misconduct;
any other liability that the law does not allow us to limit.
This section does not change the Participation Agreement, which deals with the risks of taking part in fencing.
12. Ending your account
You may stop using Globus and ask for your account to be deleted at any time, as described in our Privacy Policy. Amounts you already owe remain due. We may close accounts as described in section 2.
13. Law and disputes
These terms are governed by the laws of the State of Texas. If you have a concern, please contact us first so we can try to resolve it. If we cannot resolve it within 30 days, either of us may take it to the state or federal courts located in Dallas County, Texas, and both of us agree to those courts' jurisdiction.
14. Language
These terms are also available in Korean. The Korean version is a translation for convenience. If the two differ, the English version applies.
15. Changes to these terms
When we change these terms, we publish the new version with its effective date in the app and on our website. If the change is significant, we ask you to accept it in the app before you book again.
